CARFERNO TERMS OF SERVICE & USER AGREEMENT
Effective Date: September 28, 2026
Operated by: Carferno.com LLC
These Terms of Service (“Terms”) govern access to and use of the Carferno website, mobile application, and related services (“Carferno” or the “Platform”).
By creating an account, accessing the Platform, posting a repair request, submitting or accepting a quote, or otherwise using Carferno, you agree to these Terms.
1. CARFERNO IS A MARKETPLACE PLATFORM
Carferno provides a technology platform that allows vehicle owners seeking automotive services (“Vehicle Owners”) to connect with automotive service providers (“Mechanics”).
Carferno does not perform automotive repairs or maintenance and is not a repair shop or the provider of the automotive services offered through the Platform.
Mechanics use Carferno to independently offer their services to Vehicle Owners. A Mechanic’s use of Carferno does not constitute an endorsement, warranty, or guarantee by Carferno regarding that Mechanic or the services the Mechanic provides.
2. VEHICLE OWNERS CHOOSE THEIR MECHANIC
Vehicle Owners may receive quotes or other information from Mechanics through the Platform.
The Vehicle Owner—not Carferno—decides which Mechanic, if any, to hire.
Carferno does not select a Mechanic for the Vehicle Owner, direct the Vehicle Owner to hire a particular Mechanic, or make the final hiring decision on the Vehicle Owner’s behalf.
Vehicle Owners are responsible for reviewing the information available to them and deciding whether a particular Mechanic is appropriate for their needs.
3. REPAIR AGREEMENT IS BETWEEN THE VEHICLE OWNER AND MECHANIC
When a Vehicle Owner accepts a Mechanic’s quote or otherwise hires a Mechanic, the agreement for automotive services is between the Vehicle Owner and that Mechanic.
Carferno is not a party to the repair agreement.
The Mechanic is responsible for the work the Mechanic agrees to perform, including applicable estimates, authorizations, parts, labor, workmanship, warranties, invoicing, taxes, permits, licenses, regulatory requirements, and other obligations applicable to the Mechanic or repair.
The Vehicle Owner is responsible for communicating accurately with the Mechanic, authorizing work, providing lawful access to the vehicle and service location, and paying amounts properly agreed upon with the Mechanic.
4. MECHANICS OPERATE THEIR OWN BUSINESSES
Mechanics using Carferno control which available jobs they choose to pursue, whether to submit a quote, the amount and terms of their quotes, their availability, the services they offer, and how they perform accepted automotive work, subject to applicable law and these Terms.
Mechanics are responsible for their own tools, equipment, transportation, business expenses, taxes, insurance, licenses, permits, qualifications, and compliance with applicable laws.
Nothing in these Terms is intended by itself to determine a user’s legal employment or independent-contractor classification. Such status is governed by applicable law and the actual circumstances of the relationship.
5. VERIFIED STATUS
Carferno may allow Mechanics to submit documentation or information for account or verification purposes.
Any “Verified” badge or similar designation means only that Carferno completed the verification steps described by the Platform at the relevant time.
Verification is not a guarantee of a Mechanic’s skill, workmanship, honesty, safety, licensing status, insurance coverage, or future conduct.
Vehicle Owners remain responsible for deciding whom they hire.
6. QUOTES, DIAGNOSES AND REPAIR INFORMATION
Quotes, estimates, diagnoses, repair recommendations, completion dates, parts selections, warranties, and other service-related information supplied by Mechanics are provided by those Mechanics, not Carferno.
Automotive problems may change or become more apparent after inspection or disassembly. Mechanics and Vehicle Owners are responsible for communicating about any change in the scope or price of work and obtaining any authorization required by applicable law.
7. DISPUTES BETWEEN VEHICLE OWNERS AND MECHANICS
A dispute concerning repair quality, workmanship, damage to a vehicle or other property, diagnosis, parts, pricing, payment, warranties, refunds, delays, missed appointments, or other automotive services is primarily a matter between the Vehicle Owner and the Mechanic involved.
Carferno may, but is not obligated to, provide communication tools, records, reporting mechanisms, account actions, or other reasonable assistance related to a dispute.
Carferno’s decision to assist with a dispute does not make Carferno the provider of the underlying automotive service or a party to the repair agreement.
Nothing in these Terms eliminates rights or remedies that cannot lawfully be waived.
8. MECHANIC RESPONSIBILITIES
Mechanics must provide accurate account and business information and must comply with all federal, state, and local requirements applicable to their services.
Mechanics are solely responsible for determining which repairs they are qualified and legally permitted to perform and for performing accepted work safely and professionally.
Mechanics may not misrepresent their qualifications, insurance, licenses, certifications, identity, services, pricing, or completed work.
9. VEHICLE OWNER RESPONSIBILITIES
Vehicle Owners must provide accurate information regarding their vehicle, requested service, location, and known symptoms or conditions.
Vehicle Owners must provide a reasonably safe and lawful location for mobile service and disclose conditions that could materially affect the safety or feasibility of performing the requested work.
Vehicle Owners should review the Mechanic’s quote, profile, credentials, applicable warranties, and other relevant information before hiring the Mechanic.
10. SAFETY
Automotive repair involves inherent risks.
Mechanics are responsible for determining whether a repair can be safely performed at the requested location and for following appropriate safety procedures.
Carferno does not supervise repair work and cannot guarantee that a particular repair, location, vehicle, Mechanic, or working condition is safe.
Users should not proceed with activity they reasonably believe presents an immediate safety hazard.
11. NO GUARANTEE OF SERVICES OR RESULTS
Carferno does not guarantee that a Vehicle Owner will receive quotes, that a Mechanic will receive jobs, that a particular Mechanic will be available, that an appointment will occur at a particular time, or that a repair will achieve a particular result.
To the fullest extent permitted by applicable law, Carferno does not provide warranties regarding automotive services independently offered or performed by Mechanics through connections made on the Platform.
12. SUBSCRIPTIONS AND PLATFORM FEES
Certain Mechanic features may require a paid Carferno subscription.
Subscription pricing, billing frequency, cancellation terms, and included Platform features will be disclosed before purchase.
Payment of a Carferno subscription gives the Mechanic access to the applicable Platform features.
It does not guarantee jobs, customers, revenue, quotes, or a particular amount of business.
13. REVIEWS AND USER CONTENT
Users may be permitted to submit reviews, photographs, messages, profile information, and other content.
Users are responsible for content they submit and may not knowingly submit fraudulent, unlawful, threatening, defamatory, or misleading material.
Carferno may moderate or remove content and may suspend or terminate accounts when reasonably necessary to enforce these Terms, protect users, comply with law, or protect the Platform.
14. ACCOUNT SUSPENSION AND TERMINATION
Carferno may suspend, restrict, or terminate access to the Platform for violations of these Terms, suspected fraud, misuse of the Platform, threats to user or Platform safety, unlawful conduct, or other conduct that materially threatens Carferno or its users.
Users may delete their accounts using the account-deletion functionality provided by Carferno, subject to retention of information where required or permitted by law.
15. LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, Carferno and its owners, officers, employees, affiliates, and agents will not be liable for losses arising solely from the independent acts or omissions of Vehicle Owners or Mechanics, including the performance or nonperformance of automotive services, except to the extent liability cannot lawfully be excluded or limited.
Carferno does not exclude or limit liability where doing so would be prohibited by applicable law.
16. INDEMNIFICATION
To the extent permitted by applicable law, a user agrees to indemnify and hold harmless Carferno and its affiliates, officers, owners, employees, and agents from third-party claims, damages, liabilities, and reasonable costs arising from that user’s unlawful conduct, violation of these Terms, or automotive services independently performed or contracted for by that user, except to the extent caused by Carferno’s own conduct or where such indemnification is prohibited by law.
17. PRIVACY
Use of Carferno is also governed by the Carferno Privacy Policy.
The Privacy Policy should be publicly available at:
Carferno.com/privacy
18. CHANGES TO THESE TERMS
Carferno may update these Terms from time to time. When legally required, Carferno will provide notice of material changes.
Continued use of the Platform following the effective date of updated Terms constitutes acceptance to the extent permitted by law.
19. GOVERNING LAW
These Terms are governed by applicable law, including the laws of the Commonwealth of Massachusetts where applicable, without eliminating any mandatory rights a user may have under the law of another jurisdiction.
